Personal Liberty
The Fourteenth Amendment to the U.S. Constitution (adopted in 1868) holds that no state shall “deprive any person of life, liberty, or property, without the due process of law.” This has been interpreted as a Constitutional protection of personal liberty.
In Roe v. Wade, the Supreme Court recognized that the right to an abortion was protected by the liberty guarantee of the Due Process Clause. In overturning the right to abortion, the Supreme Court in the Dobbs case took away this right.
