Stare Decisis
“Stare decisis” is a legal doctrine that courts will follow precedent - the decisions, rulings and opinions from prior cases - in making their decisions. This has been a foundational concept of American law since the early days of the country. However, in several decisions recently, including the decisions striking down Roe v. Wade and Miranda v. Arizona, the current Supreme Court has failed to follow precedent.
